International and legal aspect of Crimean Parliament’s decision to conduct a referendum

It has become known that Verkhovna Rada of AR Crimea has voted in favor of conducting referendum on accession of Crimea to Russian Federation on March 16

Considering that Russian Federation has carried act an act of aggression, as it is determined by provisions of UN General Assembly Resolution 3314 (ХХІХ) of December 14, 1974, in particular by intruding and attacking without a declaration of war the territory of Ukraine, undertaking military occupation of AR Crimea, however temporary is the nature of it as a result of such an intrusion and attack, launching the actions aimed at annexation with the use of force on territory of Ukraine, as well as blocking ports and coasts of Ukraine with the means of Armed Forces, using its Armed Forces, located on territory of Ukraine on the basis of lease agreement, in violation of conditions envisaged by the agreement.

The actions of Russian Federations are an act of aggression even if such actions are not of sufficiently serious nature.

It must be underscored that according to paragraph 3 of article 5 of the Amendment to the mentioned Resolution it is established that no territorial gain or special advantage, acquired as a result of an act of aggression, is or can be recognized as legal.
